Since 27 Sep 2026: environmental claims need evidence.

Since 27 September 2026, the Empowering Consumers Directive (EmpCo, Directive (EU) 2024/825) has applied; in Germany it is transposed into the Act against Unfair Competition (UWG). Terms such as “climate-neutral”, “sustainable” or “environmentally friendly” are now only allowed with proof. Without proof, companies face cease-and-desist letters, fines and reputational damage. Greenwashing has become expensive.

At the same time, the CSRD is tightening the requirements for non-financial reporting. Statements on your website have to match your ESG reporting. Anyone with gaps stands out — internally, externally, in court.

The problem: most companies don't know exactly what is written on their own website. Marketing, sustainability, and legal work in separate tools. Texts have grown over the years. Nobody has the capacity to review hundreds of pages line by line.

This is exactly where the EmpCo Audit comes in.

The groundwork that usually takes months. Done in hours.

A complete EmpCo or unfair-competition audit is costly and resource-intensive for most companies. Multiple departments read through their own website page by page for weeks, collect statements, match them with evidence, and hand the result over to the legal department or an external law firm. Depending on company size, total costs can quickly reach five figures, and significantly more for large corporations.

The EmpCo Audit does not replace your lawyers. It replaces the work that comes before them. Instead of reading through the entire website, your team gets a pre-prioritized list on the table — with every critical statement, every source location, every regulatory reference. The legal review then runs only on the passages that actually require legal judgment.

What a finding looks like

An example from our demo website “Grünwald Naturkost”, a fictitious company. Every finding in the report follows this structure.

Verbatim quote
“Our products are 100% climate-neutral. We fully offset every emission from cultivation, production and transport through certified climate protection projects.”
Location
/de/nachhaltigkeit/, section “Unser Versprechen an die Umwelt” (our promise to the environment)
Risk level
Level 5 of 5: prohibited per se (Annex I clearly met)
Legal reference
Section 5 UWG (German Federal Court of Justice, judgment of 27 June 2024, I ZR 98/23, Katjes); Annex I No. 4c Unfair Commercial Practices Directive (inserted by Directive (EU) 2024/825)
Reasoning
“Climate-neutral” is applied explicitly to the products and rests entirely on offsetting through climate protection projects. This is already misleading under Section 5 UWG (Federal Court of Justice, Katjes) and has been prohibited per se since 27 Sep 2026 (Annex I No. 4c). Project name, standard and independent verification are missing.
Second review
Confirmed by the sceptical counter-check (level 5 → 5).
Action
Revise the content and have it reviewed by legal.

Example with fictitious data. The assessment does not replace legal advice.

Most AI checks on the market work on one principle: one prompt, one run, one result that gets taken at face value. That isn't reliable. The same page can produce a different finding on every run. What gets flagged once is missed the next time.

We do the opposite. For us, an AI result is never the finished finding but a hypothesis that has to be proven. Every page is analysed in several independent runs and the results are merged. Critical statements go through a sceptical counter-check, and text and visual rendering are evaluated together. The result is an audit that is considerably more stable and complete than a single AI call.
